3.1 Account Creation

To use certain features of ShinyRank, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of unauthorized access

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account information.

5.1 Subscription Plans

ShinyRank offers the following subscription plans:

• Free Plan: Limited analyses per month with basic features
• Starter Plan: Enhanced features with higher analysis limits
• Pro Plan: Unlimited analyses with premium features

Plan features, limits, and pricing are subject to change with notice. Current pricing is available on our pricing page.

5.2 Payment Terms

• Paid subscriptions are billed monthly or annually in advance
• Payments are processed through third-party payment processors (e.g., Stripe)
• All fees are non-refundable except as required by law or as stated in our refund policy
• You authorize us to charge your payment method for recurring subscription fees
• If payment fails, we may suspend or terminate your subscription

5.3 Free Trials

We may offer free trials for paid plans. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid plan and you will be charged according to your selected billing cycle.

5.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. Refunds are provided only as required by law or at our sole discretion. No refunds are provided for partial billing periods.

6.1 Our Intellectual Property

The Service, including all content, features, functionality, algorithms, software, designs, logos, and trademarks, is owned by ShinyRank or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6.2 Your Content

You retain ownership of any URLs, content, or data you submit to ShinyRank. By using the Service, you grant us a limited, non-exclusive, royalty-free license to use, process, and store your content solely for the purpose of providing the Service. You represent that you have the right to grant this license.

6.3 Analysis Results

Analysis results, scores, and recommendations generated by ShinyRank are provided for your use. You may use these results for your own purposes, but you may not resell, redistribute, or use them to create a competing service.

7.1 Service Availability

ShinyRank is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We reserve the right to modify, suspend, or discontinue the Service at any time.

7.2 Analysis Accuracy

While we strive to provide accurate SEO and GEO analysis, we do not guarantee the accuracy, completeness, or usefulness of any analysis results. Analysis results are provided for informational purposes only and should not be the sole basis for business decisions.

7.3 Limitation of Liability

To the maximum extent permitted by law, ShinyRank and its affiliates, officers, directors, employees, and agents shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions, errors, or security breaches
• Decisions made based on analysis results or recommendations

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8.1 Termination by You

You may terminate your account at any time by deleting your account through your account settings or by contacting us. Upon termination, your access to the Service will cease, and your data will be deleted according to our data retention policy.

8.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent or illegal activity, or for any other reason at our sole discretion. We are not obligated to provide a refund for any unused portion of your subscription.

8.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive termination.

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ShinyRank operates, without regard to its conflict of law provisions.

10.2 Informal Resolution

Before filing a claim, you agree to contact us at laura@shinyrank.io to attempt to resolve the dispute informally. We will attempt to resolve the dispute in good faith within 30 days.

10.3 Binding Arbitration

If informal resolution fails, any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration organization, except where prohibited by law.

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ShinyRank regarding the Service and supersede all prior agreements.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

12.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
